General terms and conditions (GTC)

of SportOne Events GmbH,

based in Bern BE

Conclusion of contract

Upon the unconditional acceptance of your registration by the booking office, a contract is concluded between yourself and SportOne Events GmbH, hereafter referred to as S1E. The existing general contractual and travel terms and conditions form an integral part of this contract.

S1E does, however, reserve the right to change the travel description (brochure details, performance specifications and prices in the brochures and on the price lists, advertisements, on the internet etc.), before making your booking. If the booking office mediates travel arrangements or individual services from other tour operators or service providers, then you conclude the contract with that company and it is their contractual and travel terms and conditions of travel which shall apply. In the case of all “only-flight services” mediated by S1E, the operator is not the contracting party; the general contractual and travel terms and conditions of the responsible airline shall exclusively apply.

Special requests or subsidiary agreements shall only become part of the contract if they have been acknowledged unconditionally and in writing by the booking office.

Prices, terms of payment, sending the travel and flight documents

The prices for the travel arrangements can be learnt from the travel description or price lists which are valid during booking. Unless otherwise stated in the description, the prices are per person in Swiss francs. All prices are inclusive of the statutory value-added tax and they are cash prices unless also otherwise stated here in the description. Additionally, an order lump sum or registration fee may be collected during booking.

Flight prices are subject to changes without notice at all times.

If only individual parts are booked from a package tour, an accommodation is booked (with or without transfer) or otherwise a land arrangement without a flight, S1E shall collect a reservation fee of up to CHF 150 per person or order. Special booking fees remain reserved for services that were not published by S1E.

The travel arrangements shall be paid prior to the start of the trip and as follows:

The advance payments shall be due on the dates agreed when the contract was concluded. If the cost of the trip increases for example due to an increase in the number of participants, the price differences to earlier advanced payments shall be made retroactively.
The difference to the contractual price remaining after the advanced payments shall be settled with the final invoice which will be created by S1E upon completion of the programme, and which is then due for payment within 20 days without deductions and handling charges.

Withdrawal/cancellation compensation is due for payment immediately.

In the case of short-notice bookings and/or bookings with 100% cancellation costs and/or bookings for which the travel documents are immediately issued, the whole invoice amount shall be paid in connection with the conclusion of the contract. A payment which is not received on time authorises S1E to refuse the travel documents or to withhold the travel documents respectively. Unless otherwise agreed, the dispatch generally takes place via first class mail or via email approx. 10 days before departure.

Price and programme change prior to travel

S1E reserves the right to change the travel price, the travel programme or individually agreed services before the contractual start of the trip. Articles 7-10 of the federal law on package tours from 18 June 1993 (Package Travel Act) (PRG) are applicable: Price increases can only take place if the transportation costs subsequently increase, if fees or charges (such as airport taxes, landing fees, taxes) are introduced or increased or if the applicable exchange rates change.

If there is a substantial change to the contract, you may inform S1E in writing within five days after receipt of the notification regarding the contract amendment, that you wish to withdraw from the contract without cost implications or that you wish to participate in one of our suggested alternative trips. If you fail to notify S1E within five days, then the contract modification is deemed to be accepted.

Cancellation of the trip by S1E

A minimum number of participants shall apply for some of the trips offered by S1E. If this minimum number of participants is not achieved, S1E can cancel the trip at the latest three weeks before the stipulated start of the journey. S1E will reimburse you for the travel price that has already been paid. Further claims for compensation are excluded. If, following the assessment of S1E, the trip is at risk from, significantly hampered by or rendered impossible by force majeure, regulatory action, political unrest or strikes, S1E can cancel the trip.

S1E shall reimburse you for the travel price already paid; it is, however, authorised to deduct the payments incurred and which are to be verified. Further claims for compensation are excluded.

 

Programme change during the trip/termination of the trip

S1E reserves the right to change the travel programme or individually agreed services during the trip if required by unforeseeable circumstances. If the trip has to be terminated or if a programme change has to be carried out during the trip which affects a significant part of the trip, S1E shall refund you for any objective reduction in value between the travel price paid and that of the services rendered. Flight times can change at any time and they must be locally reconfirmed on-site before the return flight. If no specific information is included in the travel documents, a period of 72 hours shall apply before a return flight.

Failures of performance during the trip

If the event of the non-fulfilment or improper fulfilment of the contract on location, then you are obliged to immediately query this deficiency with the local tour guide or the local representation of S1E as well as the service provider and to demand redress.

If no remedy is provided during the trip of during your stay within a reasonable period and if it concerns a major deficiency, then you are authorised to take care of redress yourself. If you have made a complaint about the deficiency and received a notice of defects confirmation in writing, SE1 shall refund the evidenced costs incurred by the deficiency as part of the originally agreed trip.

Should a redress not be possible or if the deficiency is so serious that continuing the trip or remaining at the holiday resort cannot be reasonably expected, then you must request a written confirmation from the tour guide, the local representative or the service provider. The S1E tour guide, local representation and service provider, cannot, however, recognize any claims for damages as valid. Claims for reimbursement or compensation must be made in writing to S1E within one month after the contractual end of the trip. The notice of defects confirmation from the tour guide, the local representative or the service provider and any evidence shall be enclosed. If you do not present the deficiencies within the periods mentioned, then you forfeit your rights to redress, personal redress, reduction in the tour price, termination of the contract and compensation.

The travel organiser, SportOne Events GmbH, bears no liability for game or other sporting event postponements or cancellations.

Liability

The liability of S1E is based on Article 14 and 15 of the Package Travel Act (PRG): S1E shall not be liable for indirect damages (for example loss of earnings or similar). For damages which do not constitute personal injuries, S1E shall be liable for no more than twice the travel price. The specific rules according to clauses 3-6 (programme change before and during the trip, cancellation by S1E, performance failures during the trip), shall apply. If S1E bears liability for damages that were caused by commissioned companies (hotels, transport companies etc.), then you shall cede your claims for damages to the operator.

S1E shall assume no liability:

for loss of personal belongings, valuable objects, cash, jewellery, photo and video equipment etc. (this regulation also applies to thefts from rental cars);

in the event of loss, theft, damage or misuse of cheque and credit cards and the like;

for programme changes which can be ascribed to the non-compliance with timetables by railway, bus, ship or air transport companies etc.;

for events and excursions at the holiday resort that you did not book with the SE1 tour guide or the local representation.

for damages, which has been caused while taking part of an activity as far as the reason is not gross negligence or wilfully of S1E.

Cancellation of the trip or the flight by you, assignment of the booking

If you change or cancel a booking, then you must notify your booking office in person or by registered mail stipulating the reasons for this. The travel documents that have already received, must also be returned to the booking office. A processing fee of CHF 100 per person booked or CHF 200 per order, will be charged to you in any case; the cancellation insurance does not cover the processing fee; the equivalent insurance premiums are non-refundable in any case. In addition to the processing costs, the following cancellation costs will be collected:

Up to 91 days before departure          30% from the agreed price

90-60 days before departure              50% from the agreed price

60-31 days before departure              80% from the agreed price

30-1 days before departure                90% from the agreed price

Day of departure                                    100% from the agreed price

Change of name/service:                     CHF 100 per person

Services for which S1E has made advance payments, will be charged in full in the event of cancellation. This particularly applies to admission tickets for cultural and sporting events as well as flights and hotels. For groups, training camps and special major events (for example football world championships, Olympic Games etc.), special cancellation and modification conditions shall apply.

The modification or cancellation date shall be the day on which your explanation reaches the booking office; on Saturdays, Sundays and public holidays, the next working day shall apply. Article 17 of the Package Travel Act (PRG) shall apply for the nomination of a replacement traveller.

Individual contractual regulations shall also take precedence.

Early return

If you cancel your travel prematurely for reasons that are not justified by a non-fulfilment or improper fulfilment by S1E, then the services not made use of will be repaid provided that S1E is not charged; S1E is authorised to deduct a reasonable processing fee. Any additional costs due to the premature return journey shall be charged at your expense.

Entry and health regulations

For travel advertised in Europe, nationals of Switzerland and Liechtenstein require a valid passport or a valid identity card. For travels to other destinations (overseas) a passport is generally required with at least 6 months validity following the date of return. Otherwise, you can familiarise yourself about visa requirements and the formalities of the health police with your booking office at your destination.

Upon request, citizens of other states will be readily informed about the applicable provisions by the booking office.

You yourself are responsible for procuring the necessary travel documents and the compliance with entry, health and exchange regulations.

Insurance

S1E urgently recommends the participants to conclude a travel cancellation insurance and an additional health insurance with coverage of the costs of repatriation from abroad in the event of an accident or illness. Such insurance is provided by, for example, Allianz Travel Switzerland, AWP P&C S.A., Saint-Ouen (Paris), Wallisellen Branch (Switzerland), Richtiplatz 1, 8304 Wallisellen, Switzerland.

Guarantee

S1E in collaboration with a trustee ensures that the paid contributions and costs of your return journey in connection with your booked holiday package tour are guaranteed.

Data Protection

The information that we collect about you is used exclusively to book your travel arrangements. Furthermore, such data will not be forwarded by us to third parties.

Applicable law, place of jurisdiction

The legal relationships between yourself and S1E shall apply to Swiss jurisdiction.

For complaints against S1E, the exclusive jurisdiction is given to the courts of the city of Bern.
